Reasons and Decision

[1] On March 6, 2020, the Claimant filed an application with the GD to rescind or amend the GD initial decision.Footnote 1 The Claimant withdrew her application on July 8, 2020. The Tribunal will now close file GP-20-456.

[2] The subject of this decision is GP-20-983.

[3] The parties to this appeal have requested that I decide the appeal pursuant to Section 18 of the Social Security Tribunal Regulations based on the agreement received July 23, 2020.Footnote 2

[4] The relevant part of the agreement reads as follows:

Pursuant to section 18 of the Social Security Tribunal Regulations and subsection 66 of the Department of Employment and Social Development Act, the parties request that the General Division grant the application to rescind the General Division’s decision and give the decision that the General Division would have given in light of the new medical evidence, specifically, that the Applicant is disabled within the meaning of paragraph 42(2)(a) of the Canada Pension Plan, and that having applied in June of 2017, she be deemed disabled as of March 2016, that being the earliest date that she can be deemed disabled pursuant to paragraph 42(2)(b) of the Canada Pension Plan.

[5] I allow the appeal in accordance with the agreement.
