Decision

[1] The appeal is dismissed. The Appellant, X (Employer), has abandoned its appeal of the General Division decision of September 21, 2021.

[2] Shortly before the hearing, the Employer’s former counsel notified the Social Security Tribunal that the parties had resolved the dispute between them.Footnote 1 Counsel also advised that the Employer’s representative would not be attending the hearing, as the matter had been resolved.

[3] The Tribunal wrote directly to the Employer. The Tribunal sought confirmation that the matter had been fully resolved between the Employer and the Added Party, M. A.. The Tribunal also sought to confirm that there were no outstanding matters for the Appeal Division to address.Footnote 2

[4] The Tribunal also asked the Employer to confirm that it was now withdrawing its appeal. The Tribunal informed the Employer that if it did not receive any response and if no one appeared at the hearing on January 27, 2022, that the Appeal Division would consider the appeal to have been abandoned. And, on that basis, would dismiss the appeal.

[5] Not having received any response to the Tribunal’s letter of January 20, 2022, and no one appearing on behalf of the Employer (or Added Party) at the hearing of this matter, I consider this matter to have been abandoned. Accordingly, I am dismissing the appeal.
